IAWJ Board Member, Hon. Esther Agelan Casasnovas, Represented the IAWJ at OHCHR’s Expert Group Meeting on Legal Capacity and Access to Justice for Persons with Disabilities
Wilson, Geneva | IAWJ Board Member, Hon. Esther Agelan Casasnovas from the Dominican Republic, represented the IAWJ at OHCHR’s Expert Group Meeting on Legal Capacity and Access to Justice that was held in Wilson, Geneva on November 8-9.
Magistrate Agelan participated as an IAWJ expert on the rights of persons with disabilities. The meeting generated a dialogue of experts for the promotion of good practices in access to justice of persons with disabilities.
According to Magistrate Agelan,
“the exchange of information and resources among judges and government officials from countries where there have been great accomplishments in the protection of the rights of persons with disabilities, gave us important tools for the creation of judicial frameworks on the matter, as well as to ensure the comprehensive care modalities that promote access to justice for persons with disabilities.”
Among the key topics discussed was the rights of people with mental health issues. The experts came to the conclusion that many countries that have not signed the Convention of the Rights of Persons with Disabilities, have not incorporated Article 12 to their norms. Article 12 establishes that States must reaffirm that persons with disabilities have worldwide recognition of their legal rights. Moreover, the experts addressed the issue of obtaining evidence and testimonies from persons with mental health issues.
